Arlington Daycare Sent Child Home Bruised, Tarrant County

A Tarrant County family trusted a licensed child-care center in Arlington to care for their young son. While in the center’s care, he suffered visible injuries to his head and arm, including a black eye. According to the petition, the staff responsible for watching him could not explain how it happened.
What Happened

Visible injuries to a small child, and no one could say how.

In December 2025, the family’s young son was enrolled at a licensed child-care center in Arlington. He was in the center’s care during the day, with his family trusting the staff to watch him and keep him safe.

According to the petition, while the boy was under the center’s supervision, he sustained visible injuries to his head and arm, including a black eye. These were not the kind of marks a parent expects to see when picking a child up from daycare.

The petition alleges that the employees who were directly responsible for the boy’s safety could not explain how the injuries occurred. The petition contends that account is consistent with a child who was not being adequately watched, whether because of caregiver inattention, too few staff for the number of children in the room, or both.

What We Found

When no one can say how a child got hurt, that is the problem.

The center is a licensed Texas child-care center serving infants, toddlers, pre-kindergarten, and school-age children. Texas child-care rules require centers to supervise children at all times, to maintain proper child-to-caregiver ratios, to keep adequate staffing, and to provide a safe environment. Those are the protections meant to ensure that an adult always knows what is happening to a young child. The petition alleges the center failed to provide a safe environment, failed to keep proper watch over the child, failed to maintain adequate staffing, and failed to meet the supervision and safety requirements that apply to it.

When the people who were supposed to be supervising a child cannot say how he came away with a black eye and injuries to his head and arm, that silence itself points to a supervision breakdown. We are pursuing the center’s staffing and child-to-caregiver ratio records for that day, its supervision policies, its incident documentation, and any available footage, to establish how the boy was hurt and why no one could account for it.

What We Did

We filed suit and we are making the center answer for it.

We represent the family and have filed suit against the center in Tarrant County. We brought claims for negligence, gross negligence, and violations of the Texas Deceptive Trade Practices Act, including the failure to provide a safe environment, the failure to supervise, the failure to maintain adequate staffing, and the failure to render aid and promptly notify the parent. We are pressing the center to preserve and produce its staffing records, incident documentation, and footage, and to account for how this happened.

A daycare does not get to take a family’s money to keep their child safe, send him home with a black eye and injuries to his head and arm, and have no explanation for how it happened on its watch. We intend to hold this center fully accountable.
