Prosper Daycare Hazard Injured a Toddler, Collin County

A family trusted a licensed child-care center in Prosper with their 21-month-old daughter. According to the petition, command hooks had been placed at her eye level. Within about an hour of drop-off, her eye was injured badly enough that staff called 911 and she was taken to a children’s emergency room by ambulance.
What Happened

A hook left at a toddler’s eye level led to a 911 call within the hour.

In December 2025, the family’s daughter, who was only 21 months old, was enrolled at a licensed child-care center in Prosper. She had been at the center less than a month.

According to the petition, the center’s employees had placed command hooks at the eye level of a child not yet two years old. While she was in the center’s care, one of those hooks gouged and scraped her eye, causing a serious injury that bled heavily. It happened within about an hour of when her parents dropped her off that morning.

The injury was severe enough that staff called 911, and the toddler was transported by ambulance to a children’s emergency room, where doctors worked to assess and treat the damage to her eye. Her parents were caring for a medical emergency of their own that morning, and learned of their daughter’s injury by an urgent call from the center telling them to come right away.

What We Found

A hazard at a child’s eye level is exactly what a daycare is supposed to prevent.

The center is a licensed Texas child-care facility serving infants, toddlers, pre-kindergarten, and school-age children. Texas child-care rules require centers to supervise children at all times, to keep the environment free of hazards, to meet minimum safety requirements, to maintain adequate and properly trained staff, and to render aid and notify parents promptly when a child is hurt. Those are the precise protections meant to ensure a sharp fixture is never left at a toddler’s eye level in the first place.

Keeping hazards out of a one-year-old’s reach is among the most basic duties a daycare has. The petition alleges the center placed those hooks at eye level, failed to keep its environment safe, and failed to properly supervise. We are pursuing the center’s incident reports, its classroom-safety and supervision records, its staffing and training records, and any photographs or footage of the classroom, so we can establish the full picture of how a 21-month-old’s eye was injured on a fixture left within her reach.

What We Did

We’ve put the center on notice and we are pursuing the truth.

We represent the family and have sent the center a formal demand under the Texas Deceptive Trade Practices Act. We have prepared claims for negligence, gross negligence, and DTPA violations. Those claims cover the failure to provide a safe environment, the failure to supervise, the failure to keep adequate and trained staff, and the failure to render aid and notify the parents promptly. If the center will not resolve the matter, we are prepared to file suit in Collin County, and we are pressing the center to preserve all incident reports, classroom photographs, and footage.

A daycare does not get to take a family’s money to keep their child safe, leave a hazard at a toddler’s eye level, and treat a near-catastrophic eye injury as an ordinary day. We intend to hold this center fully accountable.
