Our client was driving on a four-lane boulevard lined with industrial plants, returning to her office in the middle of a workday. Traffic was light, the weather was clear, and she was traveling at the posted speed limit.
According to the petition, a commercial delivery truck pulled out of an industrial driveway and crossed directly into her path. She saw the truck only a split second before impact — there was no time to brake and no safe way to steer clear, with the roadway and its median around her. The collision was, on her account, sudden and unavoidable.
The force of the crash carried her vehicle across the lanes of traffic and into a water-filled ditch on the far side of the road. Her airbags deployed, her windshield gave way, and she was knocked unconscious. Emergency responders and the fire department had to extract her from the vehicle. She was taken to the hospital and treated for serious injuries.
Every driver has a duty to yield before pulling onto a roadway, to keep a proper lookout, and to avoid a collision that careful driving would prevent — and a commercial driver operating a company vehicle is held to that same standard. Under Texas law, a company is responsible for the negligent acts of an employee driving its vehicle in the course and scope of the work, and is independently responsible for putting a safe driver behind the wheel. Our client’s account, supported by the scene and the responding officer’s involvement, is that the truck pulled out across her path when she had no way to avoid it.
We are pursuing the evidence that documents how this crash happened — the Texas Peace Officer’s Crash Report, the driver’s record and any citation arising from the collision, the company’s ownership and operation of the vehicle, and any available scene or vehicle data. Our focus is on establishing fault from the records and the scene, and on documenting the full extent of our client’s injuries and the toll they have taken on her work and daily life.
We represent the injured driver and have filed a personal-injury suit in Harris County against the driver of the commercial truck and the company that operated it. Our claims include negligence in the operation of the vehicle and the company’s responsibility for its driver’s conduct. Discovery is underway, and we are pursuing the records and testimony needed to prove what happened and to establish the full scope of our client’s injuries and losses.
Our client did everything right — she was driving carefully, at the speed limit, on a road she was entitled to travel. She should not be left carrying the cost of a collision she could not avoid. We intend to hold the driver and the company fully accountable for the harm they caused.
