In November 2025, our client was working at a hotel construction site in Big Spring, Texas, helping to unload and stage furnishings as they arrived by truck.
According to our client, he had been using a small forklift and was directed to switch to a larger one. He parked the small forklift out of the way and went to continue his work — and the parked forklift rolled backward, its wheel pinning his foot against the concrete floor.
He was wearing steel-toe boots, but the weight of the machine crushed through to his foot. Co-workers took him to the hospital, where the wound was treated. According to our client, he has been unable to work since the injury and continues to deal with its effects.
A forklift that is properly maintained and properly parked does not roll backward on its own. Our investigation is focused on why this one did — whether the machine had a defective or failing brake, whether it was in a safe condition to be on the site at all, and whether the people running the construction and unloading operation followed reasonable safety practices for heavy equipment around workers on foot.
We have already sent a formal notice to preserve the forklift and any site video, photographs, and equipment records so the evidence can be inspected before it is altered or lost. As we obtain the medical records, the equipment information, and the facts about who owned, controlled, and operated the site and its forklifts, we will identify who is responsible. This matter is in its early stages, and the facts continue to be developed.
