In January 2026, the family’s four-year-old son was enrolled at a licensed child-care center in Dallas. He was in the center’s care during the day, in a classroom staffed by adults his family trusted to keep him safe.
According to the petition, while the boy was under the center’s supervision, a caregiver employed by the daycare pulled his arm out of socket. The petition alleges the center failed to report the injury to his mother. She was not told that anything had happened to her son while he was in the center’s care.
The mother realized something was wrong only that evening, at home, when her son could not move his left arm. She had to seek medical care to have the dislocated arm put back into place. The family contends that what the daycare described did not match what they later understood had happened to the child.
The center is a licensed Texas child-care center serving infants, toddlers, pre-kindergarten, and school-age children. Texas child-care rules require centers to keep children safe, supervise and protect them, train and supervise their staff, respond when a child is hurt, and notify parents of injuries. Every one of those rules exists to prevent exactly this. The petition alleges the center caused the injury through its caregiver, failed to render aid, failed to seek medical care, failed to properly train and supervise its staff, and failed to notify the boy’s mother.
A four-year-old does not come home with a dislocated arm from ordinary play, and a center should never let a parent discover that kind of injury on her own hours later. The family also contends the center’s account of the incident, and its handling of the paperwork afterward, did not square with what actually happened. We are pursuing the center’s footage, its incident records and reporting, its disciplinary and training files for the staff involved, and its supervision policies.
We represent the family and have filed suit against the center in Dallas County. We brought claims for negligence, gross negligence, and violations of the Texas Deceptive Trade Practices Act, including the injury caused by the center’s caregiver, the failure to render aid, the failure to seek medical care, and the failure to notify the mother. We are pressing the center to preserve and produce its footage and records and to account for how a child’s arm was pulled out of socket in its care.
A daycare does not get to take a family’s money to keep their child safe, let a worker pull that child’s arm out of socket, and then send him home as if nothing happened. We intend to hold this center fully accountable.
