A Dallas mother had two of her children enrolled at a licensed child-care center in Dallas. She did what any parent does: she trusted the center to keep her children safe during the workday.
In October 2021, her daughter suffered a head injury serious enough to require staples to close the wound. According to the petition, the center supplied no explanation for how the injury happened. The mother has testified that the center’s administration never notified her at all. She found out only because her daughter’s teacher called her, and when she arrived, staff acted as though nothing was wrong. The center reassured her it would not happen again.
About a year later, in November 2022, she arrived to pick up her children and found her son’s arm hanging at his side. His elbow was fractured, and it required emergency treatment and ongoing care. Again, according to the petition, the center offered no explanation for how a child in its care had been seriously hurt. No staff member had told her anything before she left.
The center is a licensed Texas child-care center serving infants, toddlers, and young children. Texas child-care rules require supervising children at all times, keeping adequate staffing, rendering aid and seeking medical care when a child is hurt, and notifying parents. The petition alleges the center fell short on each of these, and that it did so not once but across two separate serious injuries to two different children in the same family.
The pattern is what stands out. After the first injury, the mother has testified, the center reassured her it would keep a close eye on her children and that it would not happen again. That reassurance is why she kept them enrolled. About a year later, her son came home with a fractured elbow and, once more, no one at the center could say how. We are pursuing the center’s staffing and supervision records, its incident-response and notification policies, and its account of two injuries it has not been able to explain.
We represent the family and have filed suit against the center’s operator in Dallas County. We brought claims for negligence, gross negligence, and violations of the Texas Deceptive Trade Practices Act, including the failure to supervise, the failure to render aid and seek medical care, and the failure to notify the parent. Discovery is underway, and we are building the record through documents and sworn testimony to establish how two children in this center’s care were seriously injured without explanation.
