In January 2025, our client was driving along Thompson Road in Harris County. Coming the other way was an 18-wheel tractor-trailer owned by Enterprise Products Company and operated by one of its drivers.
According to the petition, the truck driver pulled out of a private driveway too wide onto the road, then tried to turn back into the drive — and in doing so drove the 18-wheeler into our client’s lane. The petition alleges the driver failed to yield the right of way, failed to keep a proper lookout, and failed to keep the large commercial vehicle under control, colliding with our client’s vehicle.
Our client was injured in the collision and required medical treatment. A loaded tractor-trailer turning across the wrong lane leaves a passenger-vehicle driver with little chance to avoid being hit — and our client could not.
Commercial trucks are held to heightened safety standards under state law and the Federal Motor Carrier Safety Regulations, and the companies that put them on the road are responsible for how their drivers operate them. The petition alleges the driver was negligent in turning the 18-wheeler across our client’s lane, and that the trucking company is responsible both for its driver’s conduct and for its own duties — including the hiring, training, supervision, and qualification of the people it allows to operate commercial vehicles.
Cases against trucking companies turn on records most drivers never see — the driver’s qualification file, the company’s hiring and training records, the truck’s inspection and maintenance history, and any electronic or telematics data from the vehicle. We are pursuing all of it through discovery, along with the crash report and our client’s medical records, to establish how the collision happened and the full extent of his injuries.
