In September 2025, the family’s three-year-old son was enrolled at a licensed child-care center in San Antonio. He was dropped off in the center’s care like any other day, with his family trusting the staff to keep constant watch over a three-year-old.
According to the petition, the little boy walked out of the building entirely on his own, and not through a single open door. The petition alleges he passed through three separate doorways before he ever reached the outside, and no staff member noticed him leaving at any point along the way.
The petition alleges the three-year-old made it all the way into a busy roadway. Good Samaritans found him in the road and called 911. According to the petition, the center’s employees had no idea the child was no longer in the building. They did not know he was gone until others brought it to their attention. The boy suffered scratches in the incident, and the petition alleges the danger to his life was immediate and extreme.
The center is a licensed Texas child-care center serving infants, toddlers, pre-kindergarten, and school-age children. Texas child-care rules require centers to supervise children at all times, to keep adequate staffing, to keep the children inside and secure, and to provide a safe environment. Those are the precise protections meant to make it impossible for a three-year-old to slip out of a building and into traffic. The petition alleges the center failed at each of these and that its supervision was so poor it did not even know a child had left.
A three-year-old who passes through three doorways and out into a road did not do so in a properly staffed, properly watched center. The danger was discovered by strangers in the street rather than by the people paid to watch him, and that is the heart of this case. We are pursuing the center’s staffing and head-count records, its door-security and supervision policies, the condition and alarming of the doors he passed through, and its account of how a three-year-old reached a busy road unnoticed.
We represent the family and have filed suit in Bexar County against the corporate entities that operate the center. We brought claims for negligence, gross negligence, and violations of the Texas Deceptive Trade Practices Act, including the failure to supervise, the failure to keep the child inside the facility, the failure to maintain adequate staffing, and the failure to notify the parents. We are pressing the center to preserve and produce its records and footage and to account for how a three-year-old walked out unnoticed.
